Welcome to Sendiee. These Terms and Conditions ("Terms") govern your access to and use of the website, platform, and services provided by Sendiee ("we," "us," or "our"). Please read these Terms carefully before using our services.
By using our services, you agree to comply with these Terms and all applicable laws and regulations. If you do not agree with these Terms, you must not use our services.
1. Use of Our Services
1.1 Eligibility
To use our services, you must be at least 18 years old or have the consent of a parent or guardian. By using our services, you represent and warrant that you meet these eligibility requirements.
1.2 Account Registration
To access certain features of our services, you may be required to create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain the security of your account by protecting your password and restricting access to your account.
- Notify us immediately of any unauthorized use of your account or any other breach of security.
- Take responsibility for all activities that occur under your account.
1.3 User Responsibilities

- Impersonate any person or entity or misrepresent your affiliation with any person or entity.

- Attempt to gain unauthorized access to our services or the servers and networks connected to our services.
1.4 Consent for Messaging
You are solely responsible for obtaining all necessary consents from your customers before sending them messages via WhatsApp or any other channel through our platform. You must ensure that your use of messaging complies with applicable privacy laws and WhatsApp’s opt-in requirements.
2. Description of Services
Sendiee provides an AI-powered platform that enables businesses to automate their customer interactions across various messaging channels, including WhatsApp. Our services include chatbot development, message automation, running marketing campaigns, and analytics to help businesses improve their customer engagement.
3. WhatsApp Business Platform Compliance
If you connect your WhatsApp Business Account to Sendiee, you agree to comply with the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, the WhatsApp Business Solution Terms, and all other applicable Meta Platform policies.
You acknowledge that Sendiee acts as a technical provider to facilitate your WhatsApp messaging, and we process WhatsApp Business Data only on your behalf and in accordance with your instructions.
You agree not to use WhatsApp messaging for spam, harassment, unlawful content, or any prohibited categories under WhatsApp’s policies.
4. Payment and Fees
4.1 Subscription and Payments
To access certain features of our services, you may be required to pay a subscription fee. By subscribing to our services, you agree to pay all applicable fees and charges associated with your use of our services.
4.2 Refunds and Cancellations
We want you to be satisfied with your purchase. If you are not satisfied with our services, please contact us within 14 days of your subscription to request a refund. Refunds will be processed in accordance with our refund policy.
5. Intellectual Property Rights
All content, trademarks, and other intellectual property rights associated with our services are the exclusive property of Sendiee or our licensors. You may not use, reproduce, or distribute any content from our services without our prior written consent.
6. Privacy and Data Protection
We take your privacy seriously. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.
6.1 WhatsApp Business Data Restrictions
We do not use your WhatsApp message content or metadata to train general-purpose AI models or for advertising purposes. Any AI training is limited to models used exclusively for your account and is performed in compliance with WhatsApp’s Business Solution Terms.
6.2 Roles in Data Processing
For personal data you provide directly to us, Sendiee acts as the Data Controller. For WhatsApp Business Data processed via our platform, you are the Data Controller and Sendiee acts as a Data Processor, processing such data solely according to your instructions and in compliance with applicable laws.
6.3 Data Retention
WhatsApp message content is retained for a maximum of 180 days unless you request its deletion earlier. Please note that even after deletion, some residual data may remain in our backup systems for a limited period.
7. Termination
We reserve the right to suspend or terminate your access to our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of our services, us, or third parties, or for any other reason.
8. Disclaimers
Our services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of our services or the information, content, materials, or products included in our services. To the fullest extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Sendiee, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, our services; (ii) any conduct or content of any third party on our services; (iii) any content obtained from our services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
10. Indemnification
You agree to indemnify, defend, and hold harmless Sendiee, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, service providers, subcontractors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services, including, but not limited to, any user content you submit, any use of our services' content, services, and products other than as expressly authorized in these Terms, or your violation of any law or the rights of any third party.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sendiee is located, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within that jurisdiction for the resolution of any disputes.
12. Third-Party Integration Disclosure
12.1 Third-Party Services
Our services integrate with third-party providers, including Meta Platforms, Inc., to deliver WhatsApp Business functionality. By using these features, you agree that such third parties may process your data as necessary to provide the service, subject to their own privacy policies.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes to these Terms, we will provide notice through our services or by other means. Your continued use of our services after the effective date of the revised Terms constitutes your acceptance of the revised Terms.
